Terms of Service

The terms governing access to the Arcana Research panel, research instruments, member portal, and related deliverables published at arcana-research.com.

Effective date: April 24, 2026

Acceptance

By creating an account, accepting an invitation, or otherwise accessing the Arcana Research platform (“Platform”), you agree to these Terms. If you do not agree, do not use the Platform. The Platform is operated by Acta Diurna LLC (“Arcana”).

Eligibility and accounts

  • You must be at least 18 years old and authorized to act on behalf of the employer you represent in any research instrument.
  • You must use a working corporate email and provide accurate identifying information. We may verify employer affiliation by domain match.
  • You are responsible for the security of your credentials and for all activity under your account. Notify us immediately of any unauthorized access.
  • One person, one account. Workspace seats are licensed per individual and may not be shared.

The research panel

The Platform exists to administer research instruments — surveys, benchmarks, and qualitative interviews — concerning enterprise AI investment, adoption, and impact. By participating, you agree:

  • To answer in good faith based on your best knowledge of your employer’s practices, and to disclose only information you are authorized to share.
  • That Arcana may aggregate your responses with those of other respondents to produce indices, reports, and benchmarks. Individual responses are not attributed to you or your employer in published outputs.
  • That research deliverables produced by Arcana — including the Heat Index, Vulnerability Index, Spend Index, Yield Index, Pulse Reports, and Business Use Case studies — are owned by Arcana, subject to your license to use them as set out in your access tier.

Confidentiality

Survey content, member portal materials, draft reports, methodology documents, and any benchmarks or indices marked confidential are the confidential information of Arcana. You agree not to redistribute, publish, or republish them outside your organization without prior written consent. Internal use within your organization is permitted.

Conversely, your individual research responses are confidential to you. Privacy practices governing your data are set out at arcana-research.com/privacy.

Acceptable use

You agree not to:

  • Submit responses you know to be false, fabricated, or misleading.
  • Reverse-engineer, scrape, or systematically extract content from the Platform.
  • Probe, scan, or test vulnerabilities outside our published security disclosure process at arcana-research.com/security.
  • Interfere with the integrity of the research, including by submitting on behalf of another person without authorization.
  • Use the Platform in violation of applicable law, sanctions, or your employer’s policies.

Deliverables and licenses

Where your access tier includes deliverables (tear sheets, dashboards, reports), Arcana grants you a non-exclusive, non-transferable, internal-use license to access and use those deliverables for the duration of your subscription or program participation. Redistribution, resale, or external publication requires a separate written license.

Fees

Some access tiers are complimentary in exchange for participation; others are paid. Where fees apply, they are set out in a separate order form or agreement. Unless stated otherwise, fees are non-refundable.

Termination

You may close your account at any time by emailing support@arcana-research.com. We may suspend or terminate accounts that violate these Terms, that we reasonably suspect of fraud, or that have been inactive for 24 months. Sections covering Confidentiality, IP, Disclaimers, Limitation of Liability, and Governing Law survive termination.

Disclaimer of warranties

The Platform and all research deliverables are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Research deliverables are statistical summaries of self-reported data and should not be relied on as the sole basis for material business, financial, or legal decisions.

Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of these Terms or use of the Platform. Each party’s aggregate liability is limited to the fees paid by you to Arcana in the twelve months preceding the claim, or US$1,000 if no fees were paid.

Indemnification

You agree to indemnify Arcana against third-party claims arising from your breach of these Terms, your submission of information you were not authorized to share, or your use of the Platform in violation of law.

Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles. Disputes will be resolved in the state or federal courts located in New York County, New York, and the parties consent to the exclusive jurisdiction of those courts.

Changes

We may update these Terms. Material changes will be communicated by email to active members at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
